License Agreement
This is a legal agreement (“License Agreement”) between the user ("You") and Deividas Bakutis.
By purchasing any Stock Media Products from www.finalwave.co.za you are acquiring a Single Person Use license, whether it's personal or commercial project. For commercial projects licensing when a team (multiple people) of artists is intended to use the models please request a quote using the form at the Contacts page.
By purchasing and downloading Stock Media Products from www.finalwave.co.za you agree to the terms of the User License Agreement below.
If you do not agree to these terms, then you must not accept the terms hereof or purchase, download, access or otherwise use any products from www.finalwave.co.za.
If you proceed to download any products, you hereby signify that you have agreed to all of the terms and conditions set forth below. The products are only licensed to you - they are not sold to you.
This is the license that allows you to incorporate 3d models purchased from www.finalwave.co.za in-to your own 3d models/3d concept designs, including for use for commercial projects. This is not an agreement of ownership. This license is non-transferable. If you do not agree to the terms, you are not permitted to use 3d models / Stock Media Products. Use the Contacts form page to submit any questions if the boundaries of licensing for your specific project are unclear.
Deividas Bakutis grants to you a perpetual, worldwide, non-exclusive, non-assignable, nontransferable, non-sub-licensable license to use Stock Media Products for personal, educational or commercial (professional) purposes. All rights are reserved and will be revoked if you do not follow these terms of use.
The products may be used Royalty Free:
Termination:
The license rights granted under this Agreement will immediately and automatically terminate without notice if you fail to comply with any term or condition of this Agreement. Upon termination, you must destroy all copies of 3d models and anything related to our Stock Media. The balance of the Agreement shall survive any such termination of license rights. Deividas Bakutis reserves the right to terminate the license of the use of the 3D models / Stock Media purchased on www.finalwave.co.za store if the user is found in breach of this License and does not remedy that breach within three (3) days of receiving
notice from www.finalwave.co.za store.
Warranty:
The 3d digital models sold on www.finalwave.co.za are not intended for real-world practical engineering applications. Deividas Bakutis will not carry any responsibility if such use takes place. For any real-world application the user shall use the 3d models at his/her own risk.
Your license for 3d models / Stock Media is nonreturnable and nonrefundable - No Refunds.
Damages, Limitations:
In no event shall www.finalwave.co.za or Deividas Bakutis be liable for any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related
to your use or inability to use purchased 3D models / Stock Media. You assume all responsibility and risk for the use of the www.finalwave.co.za website, its store, 3d models, Stock Media and information.
Stock Media Products are provided on an “as is”, “as available”, and “with all faults” basis. www.finalwave.co.za makes no representations, warranties, conditions, or guarantees as to the usefulness, quality, suitability, truth, fitness for a particular purpose, non-infringement, merchantability, or cosmetic attributes of Stock Media Products, and does not guarantee the accuracy or completeness of specifications associated with Stock Media Products, including measurements, weight, durability, strength, materials, general physical properties, regulatory compliance, other engineering or construction attributes.
Deividas Bakutis does not represent or warrant that the site or any content available for downloading through the site will be free of viruses or similar contamination's of destructive features. You assume all risk for any damage to your computer systems and network for any damage to your computer system by obtaining Stock Media Products, including any damages resulting from computer viruses.
Intellectual Property:
The products contained herein are owned / are the property of Deividas Bakutis.
Other-Party Intellectual Property:
Some 3d models contain graphic materials like, logos or product names representing real-world objects of Third Parties. The use of these kind of images is at your own discretion. www.finalwave.co.za nor Deividas Bakutis will take any responsibility should you use such content on any of your projects.
Deividas Bakutis and www.finalwave.co.za does not own or license any Other-Party Intellectual Property. Deividas Bakutis and www.finalwave.co.za does not in any way make any representations or warranties about Other-Party Intellectual Property associated with Stock Media Products. You are solely responsible for determining the need for and, if appropriate, obtaining any needed Other-Party clearance, consent, or release to use any Other-Party Intellectual Property in your Creations.
Indemnification:
You agree to indemnify and hold Deividas Bakutis and www.finalwave.co.za store harmless against all claims or liability asserted against Deividas Bakutis and www.finalwave.co.za store arising out of or in connection with any breach by you or anyone acting on your behalf of any of this License.

- You are not permitted to market, distribute, give, transfer, sell or sublicense the products in any form with the exception of a compiled application such as a video game.
- You may not use Stock Media Products in a way that competes with the Site or the Stock Media Products themselves.
- You may not re-distribute, publish, or make Stock Media Products available to any third party except in the form of a permitted Creation, or shared as authorized in this agreement.
- You may not publish, distribute, or make Stock Media Products available through any online clearinghouse infrastructure.
- You may not resell or redistribute Stock Media Products. For Example: You are not allowed to add the 3D models to the models you plan to sell on websites such as Turbosquid or similar.
- You may not rent, lease, sublicense, distribute, lend nor transfer 3d models, or any copy or portion of 3d models.
- You may not redistribute Stock Media Products as part of any design template, After Effects template, stock photography, video or clip art for distribution or licensing through any online stock media clearinghouse.
- You may not share Stock Media Products with other business entities (e.g. your advertising agency, dealer, subsidiary, parent company, service bureau, etc.)
- You may not store Stock Media Products purchased on www.finalwave.co.za on a file server that can be accessed via the Internet or other external network system.
- You may not aggregate funds to Purchase Stock Media Products with one or more other parties. An example of this prohibited use is a website membership where members pool their money to make a single Purchase that is shared by the members of the group. Each such member must Purchase individually.
- You will, prior to Purchase, determine the need for and, if appropriate, obtain any needed third-party clearance, consent, or release to use Other-Party Intellectual Property shown in the digital rendering of Stock Media Products, and shall not use Stock Media Products to infringe any party’s Intellectual Property rights.
- You may not use Stock Media Products for any defamatory, harassing, pornographic, obscene, or racist purpose, or to infringe any party’s Intellectual Property rights.
- You may not use 3d models at more than one physical location.
- Sample models available for non-commercial use only.
- You are free to use www.finalwave.co.za products as part of project that features a business logo or trademark, but www.finalwave.co.za products cannot be an actual component of the business logo or trademark.
- It is not in any cases permitted to sell or distribute any of these 3D Models in an modified or unmodified form, or where the derived product you are selling or distributing is a 3D model. IN OTHER WORDS: Do not sell or distribute any of these 3D models (modified or not) by itself or in bundles.
- You may not misrepresent yourself as the creator of Stock Media Products.
- Deividas Bakutis may revise and update this License at anytime and without notice.
The products may be used Royalty Free:
- For personal or commercial use.
- For advertising or promotional use.
- For website or in any electronic devices.
- In broadcast, multimedia, video games or animation.
- In books or magazines.
- The products may be modified for individual style and appearance.
Termination:
